Minimalist.. to begin with, I am not here to judge you or anyone else and I don't think sledge ever had those intentions. Hence, please don't take any of the comments personally.

After I answered Neha's question, which I know is the correct answer, I asked her a simple question i.e. is it ethical to apply for H1 visa when a person does not have a job offer, especially when the entire legal immigrant community knows that for last few years due to the visa cap it is very hard to obtain a new H1 even if you have a valid job offer.
I totally agree with you that no one on the face of this earth is a pure saint but ours (legal immigrants) is a small hardworking community, which most often understand each others pains, and that's the reason this forum exist.
Now, I ask you in the most humble way, what would you have done if your would-be employer had sponsored the visa but due to the lottery your application was never even selected for processing. To top that you learn from all over the world that companies like Wipro, Satyam and desi body shops applied for H1's, which they probably won't even use. Don't get me wrong.. I am a proud Indian and proud what these companies have archived..
don't have the guts to take care of anything person to person. That will only go to show how right the right things you do are. Do you know how a person that never does a wrong thing ( "I always do the right thing regardless of the time or place") threatens that he will bring people who do not belong in the conversation to the conversation to show how capable he is.

Basis for this "trust", please?
If USCIS continues to under perform, as they have been doing always till now (reason why EB3 ROW has moved substantially), then EB3 India will temporarily move forward this July.
My gut feeling is that it may move to end of 2005, this is to enable DOS utilize as many VISA numbers as possible during the last quarter of the FY before the unused numbers goes down the drain.
This is what Ron Gotcher also has specified.

FYI, people who sent applications on Jun 22th to NSC and their I-140 were approved at TSC, have not received receipts yet.
NSC is around 10 days ahead TSC issuing receipts.
I would say, July filers be patient.

I have been waiting for the FP in the hope that they will be issuing it soon, its already Feb and I have not received it yet. Im the only one who has not recieved the notice yet in my friends circle, I have opened an SR last week. Mine is TSC application. Are there any TSC guys yet to receive the FP notices. Overall are there a significant number of people still waiting or is it just a few of us

This myth has never been successfully countered in the media or any other PR or lobbying channel by the legal immigration crowd.
The standard line amounts to this:
We are highly skilled we are legal and we are stuck and dont deserve this.
This is not good PR. Nobody cares about this.. it will get us nowhere..
We need to have a standard message apart from all other humint crap..
1) legals cannot undercut US jobseekers because of strict labor laws. Employers are paying a premium in wages as well as legal fees to retain their legal alien workforce. IT would be foolhardy of them to go through the hassle if local talent was easily available.
2) legals are in most cases paying taxes for which they may never realize the benifits like social security.
We need to let it be known in a firm polite manner that
1) we are giving more than we are getting and are not free loaders
2) we are not harming or displacing anyone.
I dont think this can be perceived as tryng to distance ourselves from undocumented workers. There are rare moments when the media does focus on legal immigrants as a group lets make the most of it.
I would say that Social Sec Taxes and Medicare are unfair taxes. Some H-1Bs (read people from India and China) are not treated the same way as citizens, Green Card holders, and othe H-1Bs (read from Western Europe). Since they wont give us GC's.., we have to eventually go home. This implies, no Medicare or Social Sec benefits. Going by a conservative estimate.. there are about 500,000 GC applications in the blackhole for an average of 3 yrs. Each pays on an average $4,200 SC and Medicare taxes. So the state owes us $6.3 Billion... We sincerely request that we be treated fairly and our money be given back to us.. OR.. easy for them, give us GC

SORRY Fellas, I cannot send this out unless the provision for H1b nenewal be added to it. I know IVs main concern is reg the backlogged GC cases, however, I would request that future of the H1b should also be addresed. I now feel that even contributing to the IV was a mistake because you are not taking a broader view of this issue. Please try to include the clauses affecting H1bs also in your letters. Particularly simple technical aspects like renewing H1b beyond the 6 years period is a MUST and one of the things that can be MOST easily achieved if asked for.
You seem to be acting more in your interest than larger good of the members of this community. You have been quietly browsing this website all this time and suddenly became a member and started whining and complaining of what IV is doing. You don't need to get hyperactive and start freaking out. Relax and do what IV is requesting you to do at this time. Honestly, I don't see why NumbersUSA would use our information to develop a counter attack. What we want is straightforward and should be straightforward. Everyone knows who are the senators who listen to our lobbysts. Don't worry with that. Trying to fight against the desire of the American people and sneak in provisions on our behalf is not working. If NumbersUSA is comprised of 200,000+ very active members, chances are they will demolish us every time if we try to go against their desire. This is not like passing the 80's amnesty anymore. The Internet out there has proven to be a very powerful democratic tool on this. If you add provisions there such as temporary increase in visa numbers (enough to take the GC applicants veterans out of this mess) and similar modest proposals which do not increase the number of greencard significantly and coordinate with NumbersUSA, then we may succeed. Believe me I called IV members when this organization was created to explain this, but no one gets it. Persuading certain lawmakers to come up with the proposals on our behalf is the easy part. AILA has been doing this for a long time anyway. As long as you have the money and connections to do so. I am not taking the IV merit away. I do give them credit for organizing the structure and collecting the resources. However, this is not about credits or discredits. Think about it and figure out who actually blocked S.2611/1934 last year. Hint:It was not lawmakers. Note that we should try to come up with provisions enough to minimize the greencard waiting times, not making the priority current for everyone, although that would be obviously ideal.

You effing ahole.. Are you following any news lately? See how many states are trying to take criminal action against those who made such loans falsifying the documents. The ones who "made" the loans collaboarted with the borrower to bring up stated income.

I know this might have been discussed but when is the RD if the application is moved (by uscis) from NSC to TSC?
My I140 was approved by TSC sometime back. My 485/EAD/AP were sent to NSC in first/second week of July. Finally got the receipt last week. The receipt says that my application is received on Sept 5th - which is not true (it was sent in JULY); based on this notice it seems they are recording the RD as the day when they enter the application details in their system and not the day when it is actually physically received by them.
I thought its other way round based on FAQ. Am I missing something? is it worth calling them on this? Thanks.
